Terms and Conditions (T&Cs)

1. Scope of Application

These Terms and Conditions apply to all contracts concluded between Teddywear & Co and consumers through this website.

A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor self-employed (§ 13 German Civil Code – BGB).

3. Conclusion of Contract

The presentation of products on this website does not constitute a legally binding offer.
By placing an order, the customer submits a binding offer to purchase the selected goods.

The contract is concluded once Teddywear & Co confirms the order or dispatches the goods.

4. Prices and Shipping Costs

All prices stated on the website are final prices in euros.

In accordance with § 19 UStG, no VAT is charged (small business regulation), if applicable.

Shipping costs may apply and will be clearly displayed during the checkout process.

5. Payment Terms

Payment is made in advance (prepayment), unless another payment method is expressly offered during checkout.

Production and shipment of the goods will only begin after full payment has been received.

6. Delivery

Delivery is made to the address provided by the customer.

Delivery times may vary. For customised or individually printed products, delivery times may be extended due to the production process.

7. Ownership of Designs and Custom Products

All designs, prints, graphics, texts, images, and product ideas created by Teddywear & Co are the intellectual property of Teddywear & Co.

This applies in particular to:

  • the design of printed textiles,

  • the design of customised or personalised products, and

  • the design of custom-made and individual orders.

Any use, reproduction, distribution, or commercial exploitation is only permitted with prior written consent of Teddywear & Co.

Consequences of Breach

Any unauthorised use, reproduction, distribution, modification, or commercial exploitation of designs or products belonging to Teddywear & Co constitutes a breach of intellectual property rights.

8. Right of Withdrawal

Consumers generally have the right to withdraw from the contract within 14 days from the date on which the goods are received by the customer, as confirmed by shipment tracking.

This right of withdrawal does not apply to customised or personalised products, as these items are made according to individual customer specifications.

Further details regarding the right of withdrawal are set out in the separate Withdrawal Policy.

In the event of such a breach, Teddywear & Co reserves the right to:

  • demand the immediate cessation of the unauthorised use,

  • assert claims for damages, and

  • pursue any further legal remedies available under applicable law.

9. Returns and Exchanges

Items purchased directly from this website may be returned within 14 days of delivery, subject to the statutory right of withdrawal, provided they are unused, unworn, and in their original condition.

Customised or personalised items are excluded from returns and exchanges, as they are produced according to individual customer specifications.

In the case of a voluntary exchange, the customer shall bear the costs of return shipping.
A return shipping label will not be provided.

Customers are strongly advised to carefully review product measurements as well as washing and care instructionsbefore placing an order.

10. Warranty

Statutory warranty rights apply.

11. Liability

Teddywear & Co shall be liable without limitation in cases of intent and gross negligence.

In cases of slight negligence, Teddywear & Co shall only be liable for the breach of essential contractual obligations and only for damages that were foreseeable at the time the contract was concluded.

12. Applicable Law

The law of the Federal Republic of Germany shall apply.

Should any provision of these Terms and Conditions be or become invalid or unenforceable, the validity of the remaining provisions shall remain unaffected.
